Welcome to The Cube VR & Lounge. We kindly ask that you familiarise yourself with the rules and restrictions that govern the use of our website(s), services, and applications. This includes any requests for information or purchases of the experiences offered through our website(s) (collectively, the “Services”). Your purchase of any Services will also be subject to additional terms provided by us during the sales process. Please read these Terms of Service (the “Terms”) carefully as they constitute a binding contract between you and IN2TECH LTD (Company Registration Number 15726728, “The Cube VR & Lounge,” “we”, “us” and “our”). By using the Services in any way, you agree to be bound by all of these Terms, which will remain in effect while you use the Services. These Terms include the provisions in this document as well as those in the Privacy Policy. By using this website and the Services, you agree to be bound by the Privacy Policy.
1. BOOKINGS
1.1 The person making the booking, All Participant(s) and/or accompanying adult understands and acknowledges that they are agreeing to our waiver, If you are making a booking on behalf of other members of your party and/or you are making a booking for other Participant(s), it is your obligation to ensure that all player(s)/participant(s) have read and agreed to our waiver which can be viewed here or at: https://www.atthecube.co.uk/waiver
1.2 Please be aware that submitting a booking does not imply acceptance. Our acceptance of your booking will be confirmed by sending you a booking confirmation, at which point a contract will be formed between you and us.
1.3 We do not accept bookings from persons under the age of 18. Should you breach this condition, we reserve the right to refuse access to The Cube VR & Lounge and cancel the booking without compensation.
1.4 To prevent fraud, we may carry out checks or request additional identification after your booking to verify the legitimacy of your purchase. If you refuse to provide us with the additional identification and/or we suspect fraud, we reserve the right to cancel your booking.
1.5 We will process your personal details in accordance with these Terms and Conditions and our Privacy Policy. By providing us with this information, you acknowledge that the processing of your personal information is necessary for us to perform our contract with you. You also consent to our using your personal details to contact you in relation to service information, including, but not limited to, information about changes to these Terms and Conditions.
1.6 Please inform us of any change of address, or contact phone number or email address, before and after you receive your booking confirmation. Please use the contact form on our website to submit your request. Our contact details are included in these Terms and Conditions.
1.7 We prefer to contact you by email. Please ensure that your email address is up to date and that your email filter settings allow us to reach you.
1.8 Please be aware that our pricing model is dynamic and subject to change. Throughout the year, we may offer seasonal promotions and discounts. Once your booking has been made, the price you have paid will be confirmed.
1.9 We do our utmost to ensure the prices displayed on our website are accurate, however, errors may occur.
1.10 Should we discover an error in the price of your order, we will contact you by email at the email address provided during the booking process as soon as possible to inform you. In the event of a pricing error, we will either cancel your booking and refund the price paid (including any booking, transaction or supplementary fees) or process your order at the correct price. Please note that we cannot process your order until we have received further instructions.
1.11 In the event that we are unable to reach you via the contact information you provided during the booking process within a reasonable timeframe, we will consider your booking cancelled and will notify you via email.
1.12 If you are making a booking on behalf of other members of your party, it is your obligation to ensure that all additional players/participants have read and agree to these Terms and Conditions and are fully aware of all pertinent information pertaining to the booking. We cannot assume liability in the event that any member of your group is unable to participate as a consequence of your failure to provide them with all relevant data. Please note that if other players choose to revoke their acceptance of these terms and conditions at any point after purchase, no refunds will be offered.
1.13 A confirmation will be sent to the email address that you provide when making your booking. It is your responsibility to ensure that you have provided us with a valid email address when making your booking.
2. BILLING
2.1 We use a third-party payment processor (the “Payment Processor”) to bill you. Please note that the processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to these Terms. Currently, we use Stripe Payments Europe, Limited, as our Payment Processor.
2.2 Please refer to Stripe's Terms of Service at https://stripe.com/gb/legal/consumer and their Privacy Policy at https://stripe.com/gb/privacy for further information. We cannot be held responsible for any errors or omissions by the Payment Processor.
2.3 By selecting the option to purchase Services, you agree to pay us, via the Payment Processor, all charges at the prevailing prices for the Services in accordance with the applicable payment terms. Furthermore, you authorise us, through the Payment Processor, to charge your selected payment provider (your "Payment Method"). You agree to make payment using that selected Payment Method. We reserve the right to correct any errors or mistakes that the Payment Processor makes, even if it has already requested or received payment.
3. CANCELLATION, CHANGES AND REFUNDS
3.1 Unless otherwise stated in these Terms and Conditions, refunds will not be provided in any circumstance. Please be aware that this does not affect your statutory rights as a consumer.
3.2 We reserve the right to vary the opening and closing dates and times of The Cube VR & Lounge. We also reserve the right to close all of The Cube VR & Lounge for any reason, including, but not limited to, technical, health and safety, and/or operational reasons, or due to special events or private functions.
3.3 Please verify the scheduled date and time of your booking as we cannot guarantee to inform you of any changes or cancellations. You are responsible for any costs incurred due to changes in travel arrangements, accommodation, or other related expenses. We will not be liable for any additional compensation.
3.4 In the event of a cancellation or significant change to your booking, including the date and time, we will endeavour to inform you in advance by email using the email address you provided when making your booking. In urgent cases, we may attempt to contact you by telephone using the contact number you have provided when making your booking.
3.5 If we need to reschedule your booking, you will be given the option of exchanging your booking for a new date/time or a refund.
3.6 Should you wish to reschedule your booking, please do so within 48 hours of making your original booking. Please note that changes are made subject to availability, so we recommend contacting us as soon as possible to increase the likelihood of securing your preferred new time slot and date. There may be a change in price (increase or decrease in price) depending on the new time and date you choose.
3.7 An admin fee of £2.50 may be charged for rescheduling a booking.
3.8 If there is a decrease in price after rescheduling the booking, an admin fee of £2.50 will be deducted from the difference in price balance before being refunded.
3.9 If there is a decrease in price after rescheduling the booking and there is insufficient balance from the difference in price, an admin fee of £2.50 will be will be charged to the payment card used for the booking.
4. ATTENDING THE CUBE VR & LOUNGE
4.1 Please be advised that admittance to The Cube VR & Lounge is subject to these Terms and Conditions. Should any of these Terms and Conditions be breached, you may be refused admittance to The Cube VR & Lounge or removed from the premises without entitlement to a refund.
4.2 Furthermore, you are required to comply with any reasonable instructions given to you by our personnel or any third party instructed on our behalf whilst you are inside The Cube VR & Lounge.
4.3 Please note that you are required to comply with all health and safety rules and security requirements in place at The Cube VR & Lounge, including, but not limited to, security searches for the safety of all attendees.
4.4 We reserve the right to refuse admission or to remove you from The Cube VR & Lounge in certain circumstances without any right to a refund. Such circumstances include, but are not limited to, consuming alcohol or illegal substances before or whilst at The Cube VR & Lounge. Furthermore, we reserve the right to ask you to leave if you are involved with abusive, threatening, drunken or other anti-social behaviour. We also have the right to ask you to leave if you carry offensive weapons or illegal or prohibited substances or make unauthorised audio, video or photographic recordings on our premises.
4.5 Please be aware that The Cube VR & Lounge includes intense gameplay in virtual reality. By attending The Cube VR & Lounge, you agree to take all reasonable steps to ensure your own safety, including consideration of any personal medical conditions. Please exercise caution and attention to avoid injury, trips, and falls at The Cube VR & Lounge.
4.6 The Cube VR & Lounge is open to guests aged 13 years of age and over.
4.7 Please note that bookings with guests aged between 13 and 17 years of age must be supervised by an adult aged 18 years or above.
4.8 Please be advised that taking photographs and/or video recordings of the virtual reality experience/area at The Cube VR & Lounge is expressly prohibited.
4.9 Unless prohibited, you may take photographs and/or video recordings of the lounge area of The Cube VR & Lounge for private use only. These may not be sold or used for any commercial or public purpose.
4.10 You hereby consent to the unrestricted use of images by us and/or our authorised representatives in any form of publicity, including but not limited to print, digital, and online formats. Furthermore, you grant us and/or our authorised representatives all rights in the images and materials, including copyright and other intellectual property, subject to our agreement.
4.11 Please note that the videography and photography of staff members without explicit authorisation are strictly prohibited.
4.12 Kindly arrive 15 minutes prior to the scheduled start time of your booking. Late arrivals may not be permitted and no refunds will be offered.
5. PHOTOSENSITIVITY WARNING
5.1 Please be aware that The Cube VR & Lounge is a highly sensory experience that includes flashing images and lights throughout. This may be a concern for those who have suffered from seizures or epilepsy.
5.2 Those with sensitivities to flashing images and lights are advised to consult a doctor prior to their visit if this is a concern.
6. PRIVACY POLICY
6.1 For further details on the manner in which your personal data is managed responsibly, please refer to our Privacy Policy, which is available at: https://www.atthecube.co.uk/privacy
7. GENERAL
7.1 These Terms and Conditions, together with any contracts that may be formed between us, shall be subject to the laws of England and shall be exclusively subject to the jurisdiction of the English Courts in the event of any dispute.
7.2 Furthermore, no third party shall be entitled to enforce any of the terms of the contract between you and us, either under the Contracts (Rights of Third Parties Act) 1999 or otherwise.
7.3 These terms and conditions may be amended at any time. Please refer to the date at the top of this document to ascertain when the latest amendments were made. When you place your booking with us, the terms and conditions that apply to your contract with us are those in force at the time of your booking.
7.4 Please note that we cannot accept any liability for any loss or damage you may incur due to a failure by you or anyone acting on your behalf to comply with these terms.
7.5 Please note that this does not affect any of your statutory rights or any liability on our part which cannot be excluded by law.
7.6 Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
